Hospital Workers Dezan v. Dignity Healthcare, et al., San Bernardino Superior Court, Case No. CIVDS1516658 |
After four and a half weeks of trial with co-counsel Janelle Carney, the jury came back with a favorable verdict for my three clients who were employed as nurses at Community Hospital of San Bernardino. After hearing the testimony, the jury awarded my clients who were not paid for all of their time that they worked as registered nurses for the hospital. The global jury verdict was approximately $240,000 for failure to pay all wages due to an unfair rounding policy, as well as premiums for missed, late and short meal and rest breaks. | Appx $240,000 |
Plumbers The Regents of the University of California v. Public Employment Relations Board, case number B305934, in the Court of Appeal of California, Second Appellate District (2021) |
In a decision, the Court of Appeal upheld an April 2020 Public Employment Relations Board decision that found UCLA fired two workers in its plumbing department, Manuel Saldivar and Victor Flores because of their union involvement in Teamsters Local 2010. The appeals court said the timing of the decision to fire the workers, as well as the harshness of the penalty, indicates an unlawful motive behind the firings, not errors in the workers' time cards as the university claimed. | The underlying decision by the Public Employment Relations Board found that the two plumbers were entitled to reinstatement of their jobs as well as back wages. |
