{"id":48,"date":"2021-05-25T19:41:58","date_gmt":"2021-05-25T19:41:58","guid":{"rendered":"https:\/\/www.saluskylaw.com\/insights\/?p=48"},"modified":"2021-07-06T23:20:44","modified_gmt":"2021-07-06T23:20:44","slug":"your-rights-as-california-employees-if-you-get-sick-with-covid-19","status":"publish","type":"post","link":"https:\/\/saluskylaw.com\/insights\/your-rights-as-california-employees-if-you-get-sick-with-covid-19\/","title":{"rendered":"All About Your Rights As A California Employee If You Get Sick With COVID-19"},"content":{"rendered":"\n<p>If you fall victim of COVID-19, we&#8217;ve put together commonly asked questions and answers about your rights<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>What is my employer required to do by law in order to keep my work environment as safe as possible?<\/strong><\/h5>\n\n\n\n<p>Employers are required to implement a site specific written COVID-19 Prevention Program to address COVID-19 health hazards and correct any unsafe or unhealthy conditions.&nbsp;Employers are also required to provide face coverings for workers.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Am I entitled to any paid sick leave from my employer?<\/strong><\/h5>\n\n\n\n<p>Yes.&nbsp;The Healthy Workplaces Healthy Families Act of 2014 requires employers to provide paid sick leave to individuals who work in California for at least 30 days within a year of employment.&nbsp;Paid sick leave accrues at the rate of one hour per every 30 hours worked, paid at the employee\u2019s regular rate of pay.&nbsp;Employees may use accrued paid sick days beginning on the 90th day of employment.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Can I use paid sick leave if I have symptoms of COVID-19?<\/strong><\/h5>\n\n\n\n<p>Yes.&nbsp;Accrued paid sick leave may be used by an employee for themselves or to care for a family member who is experiencing symptoms.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Can my employer retaliate against me for disclosing that I have been diagnosed with COVID-19?<\/strong><\/h5>\n\n\n\n<p>No.&nbsp;It is unlawful to retaliate against a worker for disclosing a positive COVID-19 test or diagnosis.&nbsp;(Labor Code section 6409.6)<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Can my employer retaliate against me for taking paid sick leave if I am experiencing COVID-19 symptoms or have been exposed to COVID-19?<\/strong><\/h5>\n\n\n\n<p>No.&nbsp;It is unlawful to retaliate against a worker for taking paid sick leave.&nbsp;(Labor Code section 246.5)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>If you fall victim of COVID-19, we&#8217;ve put together commonly asked questions and answers about your rights What is my employer required to do by law in order&hellip;<\/p>\n","protected":false},"author":1,"featured_media":49,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[],"tags":[],"class_list":["post-48","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.11 -
